Feds head to court to seek dismissal of Twin Metals lawsuit

Government lawyers go to federal court Tuesday to seek dismissal of a lawsuit by developers of the proposed Twin Metals copper-nickel mine who are seeking to regain their mineral rights leases.

The Obama administration last year declined to renew the longstanding leases that Twin Metals needs for the underground mine near Ely in northeastern Minnesota. The government cited the potential harm to the nearby Boundary Waters Canoe Area Wilderness.

Twin Metals sued last fall to get those leases back, saying it has already invested $400 million, while its congressional supporters are trying to persuade the Trump administration to reverse that decision.

The government argues that the U.S. District Court for Minnesota should dismiss the lawsuit because it's a contract dispute that must be brought in the Court of Federal Claims.



Top German court strengthens intersex identity rights

Germany’s highest court has decided that people must be allowed to be entered in official records as neither male nor female, saying in a ruling published Wednesday that authorities should create a third identity or scrap gender entries altogether.

The Federal Constitutional Court ruled on a case in which a plaintiff, identified by advocacy group Dritte Option only as Vanja, born in 1989, sought to have their entry in the birth register changed from “female” to “inter/diverse” or “diverse.”

Officials rejected the application on the grounds that the law only allows for children to be registered as male or female, or for the gender to be left blank.

The plaintiff argued that that was a violation of their personal rights. In a three-year legal battle, Vanja provided courts with a genetic analysis showing the plaintiff has one X chromosome but no second sex chromosome. Women have two X chromosomes, while men have one X and one Y chromosome.

The supreme court found that the law protects sexual identity, which has a “key position” in how individuals perceive themselves and are perceived by others. It said that “the sexual identity of those people who can be assigned neither to the male nor the female sex is also protected,” and said the constitution also protects them against discrimination because of their gender. The government has until the end of 2018 to draw up new rules.



Court extends house arrest for Russian theater director

A court in Russia's capital ruled Tuesday to extend the house arrest of a widely revered theater and film director.

Kirill Serebrennikov was detained and put under house arrest in August in a criminal case that sent shockwaves across Russia's art community and raised fears of return to Soviet-style censorship.

Moscow's Basmanny District Court decided to keep Serebrennikov under house arrest until Jan. 19 per investigators' request.

Investigators have accused him of scheming to embezzle about $1.1 million in government funds allocated for one of his productions and the projects he directed between 2011 and 2014.

Serebrennikov has dismissed the accusations as absurd.


Relatives of Slain US Troops Describe Loss to Jordan Court

Relatives of two of the three U.S. military trainers shot dead at the gate of a Jordanian air base last year have described the pain of their loss to a military court trying the alleged killer.

The family members attended a court hearing in Jordan's capital Monday and will remain until the verdict, expected next week.

A Jordanian soldier charged with murder in the shootings faces life in prison if convicted.

The soldier, who allegedly opened deadly fire on U.S. troops at the gate, has pleaded "not guilty." The judge has said he has no ties to terrorist groups.

The defense attorney said his client fired because he feared the base was under attack The prosecutor said the defendant acted with intent, having fired dozens of rounds over several minutes.
