Court: Therapy dog didn't sway jury against sex offender

A therapy dog used to calm a testifying young victim did not influence the jury during the trial of an Ohio man who was convicted of having sex with a minor and providing drugs to another, an appeals court ruled.
The Akron Beacon Journal reports the ruling on Michael Jacobs' complaint to the 9th District Court of Appeals is considered important in Ohio because it was the first time a state appellate court heard a case challenging the use of therapy dogs during trial.
Jacobs was convicted in 2014 of having sex with a minor and providing drugs to another. He's serving a four-year prison sentence.
He argued that the Labrador-golden retriever mix brought in by county prosecutors, named Avery II, was a distraction in the Summit County courtroom.
Prosecutors contended that the dog was out of the view of jurors as it sat by the child's feet.
The court ruled that judges are permitted to allow "a variety of special allowances" for young victims of sexual abuse who testify during a trial, including therapy dogs.
"One of my main objectives as Summit County prosecutor is to fight for the rights of victims, especially children. Avery plays a vital role in how my office focuses on the needs of crime victims," prosecutor Sherri Bevan Walsh said.

Court suspends Pennsylvania attorney general's law license

Pennsylvania's highest court on Monday ordered the temporary suspension of state Attorney General Kathleen Kane's law license, a step that could trigger efforts to remove her from office as she fights perjury, obstruction and other charges.
The unanimous order by the state Supreme Court's five justices also could prompt a legal challenge from the first-term Democrat.
The one-page decision by the justices — three Republicans and two Democrats — dealt with a petition by state ethics enforcement lawyers who accused Kane of admitting that she had authorized the release of information that allegedly should have been kept secret. That allegation is also central to the criminal case against her.
In the meantime, it creates the unprecedented situation of leaving the state's top law enforcement official in charge of a 750-employee office and a $93 million budget but without the ability to act as a lawyer.
The state constitution requires the attorney general to be a licensed lawyer. But the court said in the order that its action should not be construed as removing her from office, raising the thorny question of how her office will decide which duties she can or cannot do.
Kane and her lawyers did not say Monday whether she would appeal or challenge the order, which was issued through an emergency process usually reserved for lawyers who are brazenly stealing from clients or behaving erratically in court.
In statements issued through her office, Kane, 49, said she was disappointed in the court's action and would not resign. She maintained her innocence and vowed to continue to fight to clear her name.
Then, Kane called attention to a pornographic email scandal uncovered by her office that involved numerous current and former officials there and claimed the job last year of a state Supreme Court justice.

Court: Transgender asylum seekers can't be equated with gays

Transgender people can be especially vulnerable to harassment and attacks and shouldn't be equated with gays and lesbians by U.S. immigration officials determining whether to grant asylum, a federal appeals court said Thursday.
The San Francisco-based 9th U.S. Circuit Court of Appeals issued the ruling in the case of a transgender Mexican woman who sought shelter in the U.S. on the grounds that she would likely be tortured if returned to Mexico.
Edin Avendano-Hernandez said she had been sexually assaulted by uniformed Mexican police and a military official for being transgender.
The Board of Immigration Appeals wrongly relied on Mexican laws protecting gays and lesbians to reject Avendano-Hernandez's asylum request, the ruling states.
The 9th Circuit said transgender people face a unique level of danger and are specifically targeted in Mexico by police for extortion and sexual favors.
"While the relationship between gender identity and sexual orientation is complex, and sometimes overlapping, the two identities are distinct," Circuit Judge Jacqueline Nguyen wrote. "Significant evidence suggests that transgender persons are often especially visible, and vulnerable, to harassment and persecution due to their often public nonconformance with normative gender roles."

Illinois high court: Comcast must reveal anonymous commenter

The Illinois Supreme Court has affirmed a lower court opinion ordering Comcast Cable Communications to identify a subscriber who posted an anonymous message suggesting a political candidate molests children.
The court said Thursday that the internet service provider must identify the subscriber who commented on a 2011 article in the Freeport Journal Standard about Bill Hadley's candidacy for the Stephenson County board.
The commenter, who used the online name "Fuboy," wrote that "Hadley is a Sandusky waiting to be exposed" because he can see an elementary school from his home. The comment was an apparent reference to former Penn State football coach Jerry Sandusky who was convicted of child sex abuse in 2012.
Hadley filed a defamation lawsuit against the commenter and subpoenaed Comcast demanding that it identify the subscriber.
