Lawyer asks Iowa court to reconsider sex bias case

The attorney for a dental assistant fired after her boss became too attracted to her is asking for the Iowa Supreme Court to rule on the case for a third time.
The all-male court Friday dismissed a sex discrimination lawsuit filed by Melissa Nelson against Fort Dodge dentist James Knight, ruling her termination was lawful. It was the same outcome as the court's decision from December but a different rationale.
Nelson's attorney, Paige Fiedler, asked the court Tuesday to again reconsider the ruling and allow a trial. Fiedler says in a brief the justices wrongly concluded that Nelson had a "consensual personal relationship" with Knight that justified her firing.
Fiedler says a jury could conclude their relationship was ordinary, and she wouldn't have been fired but for her good looks. |

A BAC of 0.08 or more will most likely result in a DWI (driving while intoxicated) charge, the most severe, and generally referred to as “per se” intoxication. The BAC below 0.08 will result in a DUI (driving under the influence) charge, a lower included offense. Your physical appearance such as slurred speech, bloodshot eyes, performance on field sobriety tests -- all will be considered as well as chemical tests. A driver’s blood alcohol concentration or BAC can be measured by testing the driver’s blood, breath, or urine. Generally at the scene the officer will rely upon both the physical attributes as well as the reading of the breathalyzer machine. Given the severity of the mandatory minimum sentences and the general unreliability of breathalyzer machines, blood and urine tests are now more prevalent.

Corbett to pick Stevens for Pa. high court

Gov. Tom Corbett plans to nominate state appeals court Judge Correale Stevens to temporarily fill a vacancy on the state Supreme Court.
Two people familiar with the decision told The Associated Press of Corbett's plans on condition of anonymity, saying the information was part of private conversations.
The decision comes more than a month after the opening was created following the resignation from the bench of Joan Orie Melvin. Melvin was convicted of using public employees to help her political campaigns.
Stevens will require a two-thirds approval by the state Senate to take a seat on the bench.
Stevens is a familiar face in state politics and government, and is currently president judge of state Superior Court, which handles criminal and civil appeals. His long career in public service also includes time as Luzerne County's district attorney, a county judge and seven years as a state representative.
Melvin and Stevens are both Republicans, so if he is confirmed the court will return to a four-to-three Republican majority. |
